(the “Site”), as well as any related websites, platforms, or sister-sites that operate legally under the BioLimitless brand and product/service umbrella (collectively, the “Services”).

By using the Site or Services, or by making a purchase, you agree to be bound by these Terms, along with our Refund & Return Policy and Privacy Policy, which are incorporated herein by reference. If you do not agree, you may not use our Site or Services.

ELIGIBILITY

By using our Site or Services, you represent that you are at least 18 years old and have the legal capacity to enter into a binding contract.

ACCOUNT REGISTRATION

To access certain features of our Site or Services, you may be required to register for an account. You agree to:

  • Maintain the security of your account credentials.
  • Accept responsibility for all activities that occur under your account.

BioLimitless reserves the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in misuse of the Site or Services.

USER CONDUCT

You agree not to use the Site or Services in any way that could harm, disable, or interfere with their operation or with the use and enjoyment of the Site by others. Prohibited conduct includes, but is not limited to:

• • Unauthorized access or attempts to gain unauthorized access.
  • Distribution of malware, viruses, or other harmful code.
  • Fraudulent, illegal, or unethical activities.
  • Violations of applicable laws, regulations, or these Terms.

 

SALES AND PAYMENTS

All Sales Final: As outlined in our Refund & Return Policy, all sales are final. Refunds are not available for reasons such as preference, dissatisfaction, or non-use.

Physical Products: Only damaged or defective physical products are eligible for replacement through the authorized return process. No exceptions apply for unopened, opened, used, unused, or otherwise intact products that do not meet the criteria of a damaged or defective physical product.

Digital Products & Services: Digital products and services—including but not limited to online courses, memberships, subscriptions, downloads, and AI-powered tools—are non-refundable and not eligible for return under any circumstances.

Billing Accuracy:  You agree to provide accurate, current, and complete billing, shipping, and account information. By making a purchase, you authorize BioLimitless to charge your selected payment method for all applicable purchases, including taxes, shipping, and handling fees.

For any subscription, membership, “Subscribe & Save,” or other recurring-charge purchase, you authorize BioLimitless to automatically bill your selected payment method on a recurring basis (e.g., monthly, annually, or as otherwise disclosed at checkout) until canceled in accordance with our cancellation policy.

Currency: All prices and charges are listed in U.S. dollars (USD) unless otherwise stated at checkout.

Non-Payment: BioLimitless reserves the right to suspend or terminate access to any product or service if payment is declined, reversed, or disputed.

Third-Party Processors: Payments may be processed through third-party payment processors. By submitting your payment information, you agree to be bound by the terms, conditions, and privacy policies of such processors. BioLimitless is not responsible for errors, delays, or security breaches caused by these providers.

Regulatory Compliance: BioLimitless products are sold in compliance with applicable U.S. dietary supplement regulations. Customers outside the United States are solely responsible for ensuring compliance with local laws, regulations, and import restrictions.

Export/Import Responsibility: Customers are responsible for compliance with all applicable customs, import, and export laws and regulations. BioLimitless is not responsible for products delayed, held, or rejected by customs authorities.

All BioLimitless content—including, but not limited to, website materials, digital services, courses, memberships, and AI-generated content and interactions—is provided for informational, educational, and entertainment purposes only.

INTELLECTUAL PROPERTY

All content, materials, and services provided by BioLimitless—including but not limited to product formulas, website text, product designs, logos, trademarks, videos, courses, AI-generated outputs, and digital resources—are the property of BioLimitless or are used under license from third parties. They are protected by copyright, trademark, trade secret, and other intellectual property laws.

Your purchase or use of BioLimitless products and services grants you a limited, non-exclusive, non-transferable license for personal use only. It does not grant you ownership of, or the right to resell, redistribute, reverse-engineer, or create derivative works from, any BioLimitless or licensed content, including product formulas.

USER-GENERATED CONTENT

By submitting, posting, or otherwise sharing content with BioLimitless—including but not limited to testimonials, reviews, comments, images, videos, or other materials—you retain ownership of your content. However, you grant BioLimitless a worldwide, royalty-free, non-exclusive, perpetual, and transferable license to use, reproduce, modify, publish, display, and distribute such content in connection with our business, including for marketing, promotional, and educational purposes.

You represent and warrant that any content you provide is accurate, lawful, and does not infringe upon the intellectual property, privacy, or other rights of any third party. BioLimitless reserves the right to remove or decline to use any user-submitted content at our sole discretion.

AFFILIATE PROGRAM

Partner+ Program Affiliates are independent contractors and are not employees, agents, legal partners, fiduciaries, or representatives of BioLimitless. No relationship is created other than that of an independent affiliate participating in the Program.

BioLimitless does not guarantee any income, sales, or results from participation in the Program. Affiliates are solely responsible for their business activities and must comply with all applicable laws and regulations in both the Affiliates’ and BioLimitless’s jurisdictions, including—but not limited to—Federal Trade Commission (FTC) guidelines on claims, endorsements, and testimonials, as well as all other laws and regulations governing affiliates, commissions, contractors, and online marketing practices.

Participation in the BioLimitless Partner+ Affiliate Program is governed by a separate Affiliate Program Terms & Conditions Agreement. By enrolling in the Program, Affiliates agree to comply with that Agreement, which outlines commission structures, responsibilities, and compliance obligations.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, BioLimitless shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, or business interruption, arising out of or related to your use of the Site, Services, or products.

Our total liability to you for any claim arising from or related to the purchase or use of our products or services shall not exceed the amount paid for the specific product or service giving rise to the claim.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BioLimitless, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to:

• • Your violation of these Terms or any applicable law or regulation.
  • Your misuse of the Site, Services, or products.
  • Any content you submit, post, or share with BioLimitless.

BioLimitless reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with such defense.

TERMINATION OF ACCESS

BioLimitless reserves the right to terminate, suspend, or restrict your access to the Site or Services, without notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be unlawful, harmful, or otherwise objectionable.

PRIVACY POLICY

Your use of the Site and Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference and is available here or at www.biolimitless.com/privacy-policy

By using the Site or Services, you acknowledge and agree to the practices described in the Privacy Policy.

GOVERNING LAW & CHANGES

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, or any other jurisdiction in which BioLimitless is then legally registered or operating, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in such jurisdiction.

BioLimitless reserves the right to update, modify, or replace these Terms at any time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site or Services following the posting of changes constitutes acceptance of those changes.

ENTIRE AGREEMENT

These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and BioLimitless regarding the use of the Site and Services, and supersede any prior agreements, communications, or understandings. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

FORCE MAJEURE

BioLimitless shall not be held liable or responsible for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, acts of God, pandemics, labor disputes, supply chain disruptions, acts of government, internet or telecommunications failures, or other circumstances that make performance impracticable.

SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
